Parent-Child Contacts
Regardless of the parental authority, parents have the right and obligation to maintain contacts with a child. The parent-child contacts inter alia include spending time with a child and communicating with a child, being in correspondence with a child, making use of other means of communication, including electronic communication.
How are the Child-Parent contacts arranged ?
In case when a child permanently stays with one of the parents, the contacts with the other parents are arranged for jointly by both parents. To this end, they are obligated to pursue the well-being of a child and take sensible expectations into consideration.
The role of the court of guardianship to the extent of the Child-Parent contact arrangements
If the parents are incapable of reaching an agreement, the court of guardianship shall decide upon the Child-Parent contact arrangements.
The court of guardianship may constrain the Child-Parents contacts if the court decides that such constraints are required in order to ensure the child’s well-being. The contact constraints may inter alia include prohibition of contacts with a child, prohibition of taking a child away from the place of residence and prohibition of remote communication. However, the court will prohibit the Child-Parent contacts when the court decides that the Child-Parent contacts may cause hazards to a child’s well-being.
It bears noting that the court of guardianship may change the Child-Parent contact arrangements due to a child’s well-being concerns.
